Do I have to Follow MUTCD?

The manuel on uniform traffic control devices is a regulation in New York State and needs to be followed.

Some signs, such as speed limits are actually part of NYS law and not just a regulation. While there is no sign police, the town can be liable if signs are placed improperly.

Sometimes a HOA or private owner may feel they can put up any signs they want. However, V&T section 1680 states:

"No person shall install or maintain in any area of private property used by the public any sign, signal, marking, or other device intended to regulate, warn or guide traffic unless it conforms with the state manual and specifications maintained under this section."
